Terms of Service

These Terms of Service ("Terms") govern your use of the PESADESIGN Training Academy platform at pesadesigntrainingacademy.com (the "Platform"), operated by PESADESIGN, a sole proprietorship established in the Netherlands (KVK 86727257). By creating an account or making a purchase, you agree to these Terms.
1. Accounts
- You must provide accurate information and keep your login credentials secure.
- Your account is personal to you. You may not share, sell or transfer your account or login, or let others use it.
- You are responsible for activity under your account. Tell us promptly at academy@pesadesign.com if you suspect unauthorised use.
2. Access to courses
When you purchase a course, we grant you a personal, non-exclusive, non-transferable, non-commercial licence to access and view that course's content for your own learning, for the access period stated at purchase.
You may not: download, copy, record, screen-capture, redistribute, publish, resell, or share the course videos or materials; circumvent access controls; or use the content to create a competing product.
3. Intellectual property
All content on the Platform — videos, text, graphics, code, the PESADESIGN name and branding — is owned by PESADESIGN or its licensors and is protected by copyright and other laws. Videos are watermarked and access is monitored. Unauthorised use may result in account termination and legal action.
4. Payments, pricing and taxes
- Payments are processed securely by Stripe. Prices are shown at checkout.
- Prices are stated in EUR and include or exclude VAT as indicated at checkout. VAT is applied according to the applicable rules for your location.
- We may change prices for future purchases, but changes do not affect courses you have already bought.
5. Refunds and right of withdrawal
Purchases of digital course content are subject to our Refund Policy, including the waiver of the 14-day right of withdrawal that you agree to at checkout when you request immediate access. Please read it before purchasing.
6. User comments
You may post comments on lessons. You are responsible for what you post. Do not post anything unlawful, offensive, infringing, or spam. By posting, you grant us a licence to display and moderate your comment on the Platform. We may remove comments and restrict accounts that breach these Terms.
7. Educational content — important disclaimer
The courses provide educational and training material on engineering topics, including transmission-line and tower analysis and related software. This content is for learning and general guidance only. It is not professional engineering advice for any specific project and is not a substitute for the exercise of qualified professional judgement, independent verification, or compliance with the applicable codes, standards and regulations.
You are solely responsible for any design, analysis, or decision you make in your own professional work. PESADESIGN accepts no liability for how course content is applied to real projects. Always verify results against the current governing standards and, where required, have work checked by a competent engineer.
Third-party software: PESADESIGN training is independently produced and is not affiliated with or endorsed by Power Line Systems unless expressly stated otherwise. PLS-TOWER and related names are used descriptively to refer to software topics covered in the courses. All trademarks belong to their respective owners.
8. Limitation of liability
To the fullest extent permitted by law, PESADESIGN is not liable for any indirect or consequential loss, or for loss arising from your use of, or inability to use, the Platform or course content. Nothing in these Terms limits liability that cannot be limited by law, including your mandatory rights as a consumer.
9. Termination
We may suspend or terminate your access if you breach these Terms (for example, by sharing your account or redistributing content). You may stop using the Platform at any time.
10. Governing law
These Terms are governed by the laws of the Netherlands. If you are a consumer, you also keep the benefit of any mandatory consumer-protection rules of your country of residence. Disputes fall under the competent Dutch courts, without prejudice to your rights to bring a claim locally as a consumer.
11. Changes
We may update these Terms. Continued use after changes take effect means you accept the updated Terms.
